by accepting our quote, you are also agreeing to these terms & conditions listed below.

Definitions

“The designs” means all digital files or physical signage and stationery supplied by Designs to Adore to the client. 

“The Client” means you, the person, or your authorised representative who is using us, the designer.

“The Designer” means us, Designs to Adore ABN 39945123812 and our employees. 

“The Design Fee” is the amount of renumeration agreed by the client and the designer to be paid by the client to the designer for the designs.

“Hired Items” means all goods, equipment, consumables, accessories, and packaging owned by the designer but being used by the client for the purpose of the event. These hired items need to be returned to the designer at the conclusion of the event. 

“The Site” means the location where the designs are being used.

  1. Quotes 
    All quotes are tentative until formally accepted by the client. Quotes are valid for 14 days and can be altered or withdrawn by the designer if not accepted by the client within those 14 days. A copy of these terms and conditions will be forwarded with the quote. By accepting the quote, the client is also accepting these terms and conditions.

  2. Deposit
    Once the client accepts the designers quote, a deposit invoice for 50% of the total design fee will be forwarded to the client. Payment can be made by credit card, cash or bank transfer. 
    The client will enter into a contract with the designer and agrees to accept these terms and conditions from the date the deposit is paid. 

  3. Payment
    The client agrees to pay the designer the design fee which is advised via quote. The deposit invoice which is 50% of the full design fee must be paid to the designer prior to before any designs are created. No design work will commence until the deposit is paid. The remaining 50% of the design fee must be paid by the client prior to the delivery or collection of the designs. Payment can be made by credit card, bank transfer or cash.

  4. Artwork and Proof
    It is the responsibility of the client to ensure that the layout, copy, spelling, and grammar is correct in all proofs emailed to the client by the designer. Once the client has approved the design, the designer accepts no responsibility for errors in the design and will not be liable for any re-printing required.

  5. Period of hire
    The period of hire is for a 48 hour period unless mutually agreed by the designer and the client. 

  6. Changes to the design
    All designs are made to order and the designer does not provide refunds for change of mind or change of personal circumstances. Once an order has been placed, the designer will do their best to accommodate minor changes by the client but once third party costs have been incurred, no changes can be accepted.

  7. Cancellation
    If the client cancels before design work has commenced the deposit may be refunded at the designer’s discretion. However once design work has commended, no refunds can be given.

  8. Copyright
    All designs remail the copyright of Designs to Adore and may not be reproduced with out the written permission of the designer. The designer retains the right to use artwork or elements of the design for advertising and marketing purposes.

  9. Delivery of designs
    The client agrees to collect the designs and/or hire items from the designers studio unless there is an agreement between the client and designer for the designer to deliver and set up the designs /hire items or post to client.

    The client is responsible for inspecting and checking all designs/hire items on delivery and notifying the designer within two hours of delivery of any equipment that is missing, damaged or unfit for purpose.  Failure to do so with mean the client is responsible for any damage, missing or unfit equipment on collection.

  10. Collection of hire items
    The client is responsible for returning the hire items to the designer. If the client and designer have agreed that the designer will collect the hire items, the client must allow the designer access to the site to collect the hire items at the agreed time of collection. 

  11. Damaged Hire Items
    If any hire items are found to be damaged, broken or missing, the client will be liable to pay a replacement fee equivalent to the recommended retail price. This amount will be determined by the designer and the client will be issued an additional invoice for payment within 7 days.

  12. Changes to the Terms and Conditions
    These terms cannot be altered, varied or substituted without the written consent of the designer. 

  13. Disclaimer
    The designer shall in no way be held responsible or accountable for any injury, death or loss of income caused to the client or any third party resulting from the designs.

    These terms and conditions of hire are governed by the Laws of NSW and the client and the designer submit to the jurisdiction of the courts of that state for determination of any dispute, claim or demand arising.
